In Madrid, 14th September 2006
The Association for the Families of Saharawi Prisoners and the Disappeared (AFAPREDESA), The Association Pro-Human Rights of Spain (APDHE), the State Federation of Institutions in Solidarity with the Sahrawi People (FEDISSAH), and the State Coordination of Associations in Solidarity with the Sahrawi People of Spain (CEAS - SAHARA), using the principle of the universal jurisdiction ot the Courts of Justice, present a criminal action in the Spanish National Court against Moroccan governors and military personnel for their responsability in the practice of genocide, torture, illegal detentions, missings and kidnappings to the Sahrawi people.
Between the defendants we find: DRIS BASRI, ex- Minister of the Interior
of the Kingdom of Morocco, HAMIDOU LANIGRI, currently Chief of Moroccan
National Security (DGSN), YASSINE MANSOURI, Chief of General Policies of
Studies and Documentation (DGED) and also Special Advisor to the king of
Morocco, ABDELHAK EL KADIRI former Chief of General Policies of Studies
and Documentation (DGED), ABDELASIS BANNANI, Supreme General of the Royal
Armed Forces (FAR), HOUSNI BEN SLIMAN, General of the Moroccan Royal Gendarmerie,
BEN HIMA, Commissioner of the Main directorate of the National Security
of El Aaiun and at the present time Commissioner in Agadir, ABDELHAFID BEN
HACHEM, Head of the Main directorate of Seguridad Nacional (DGSN) (right
arm of DRISS BASRI), and in the same way criminal action is presented against
all responsible in quality of being the author, accomplice or cover-up of
the crimes of genocide, kidnapping, tortures and illegal haltings.
The denounced facts took part as from 1975, year in which signature of the "Tripartite Agreements of Madrid", Spain abandoned Sahara Occidental, its 53rd province, causing the violent invasion of the Western Sahara on behalf of the kingdom of Morocco. The invasion took place by means of a bloody war and massacre against the saharaui people, which lasted 16 years The Sahrawi people remained under the domination of a foreign power, which impeded the exercise of the right to its free determination, as recognized by Resolution 1514, signed on 8th of December of 1960 at the General Assembly of the United Nations, implying through this denial, "a refusal of the fundamental human rights".
From the 31 of October of 1975 to the present time the Moroccan army has exerted permanent violence against the sahrawi people, initially in a predatory war that forced a great part of the sahrawi population, over 40,000 people to flee to the desert, as they were being persecuted and being ruthlessly bombed by the aggressor forceses with Napalm, White Phosphorus and Pumps of Fragmentation, being thrown to the emptiness from helicopters, having created Morocco a terror state and persecution in the nonIndependent Territory of the Western Sahara, that stays at the present time.
The town saharaui has undergone a serious, massive and systematic violation of the human rights to the salary exterminated part of the same one. In the present complaint the systematic plan of elimination of the town is denounced saharaui, that is made of form organized and hierarchized by the denounced people, using as personnel to its control and the military and paramilitary personal cash, coming to the levellings of dwelling, massive haltings and kidnappings in clandestine centers of halting and tortures, like Kaalat Maguna, Agdez, Skoura, PCCMI (Command post of the Movable Companies of Intervention), the BIR in the Aaiún (old Basic training battalion, Spanish), Derb Mulay Ali Cherif, Ifni, and secret others mazmorras, giving rise to the disappearance of thousands of people, of which at least, five hundred twenty-six saharauis, still today, they remain in that situation, without their relatives have knowledge some of their whereabouts, and denying to it them by the Moroccan state any news on them.
In the present complaint denunciation of form detailed and detailed the kidnapping, imprisonment and disappearance of hundreds of saharauis, during the years 1975 to 1980, that in his majority they had the Spanish nationality, and that were jailed by the forces of Moroccan occupation.
